Platform Usage Guidelines

By accessing and using Ethication™, the Ethics & Arbitration System ("EAS", "the Platform", "our service"), operated by Warren Burrows, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. Ethication™ is provided to members of participating REALTOR® Associations for the purpose of managing ethics complaints, arbitration proceedings, and committee operations in accordance with the National Association of REALTORS® (NAR) Code of Ethics and Standards of Practice.

Eligibility & Account Requirements

Who May Use Ethication™

Ethication™ is available exclusively to:

  • Members of participating REALTOR® Associations
  • Association administrators and staff
  • Authorized committee members (Grievance Committee, Professional Standards Committee)
  • Parties involved in active ethics or arbitration cases
  • System administrators authorized by Warren Burrows or participating associations

Account Registration

You must:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify your association administrator immediately of any unauthorized access
  • Be at least 18 years of age
  • Maintain a valid phone number for SMS verification and notifications

Platform Usage & Conduct

Permitted Use

You may use Ethication™ solely for:

  • Filing and managing ethics complaints and arbitration requests
  • Participating in assigned cases as complainant, respondent, or committee member
  • Viewing and managing case documents and communications
  • Attending scheduled hearings and proceedings
  • Fulfilling committee responsibilities and administrative duties

Prohibited Conduct

You agree NOT to:

  • Submit false, misleading, or fraudulent information in complaints or responses
  • Access data or cases for which you are not authorized
  • Share confidential case information with unauthorized parties
  • Attempt to breach security measures or access other users' accounts
  • Upload malicious files, viruses, or harmful code
  • Use the platform for any purpose other than legitimate ethics case management
  • Harass, threaten, or intimidate other users through platform communications
  • Interfere with or disrupt the platform's operation
  • Scrape, copy, or extract data using automated tools
  • Reverse engineer or attempt to access source code

Confidentiality & Ethics Proceedings

Ethics cases and arbitration proceedings are confidential by nature. By using Ethication™, you agree to:

  • Maintain the confidentiality of all case information, documents, and communications accessed through the platform
  • Share case information only as permitted by NAR rules and your association's policies
  • Not discuss case details publicly or on social media during active proceedings
  • Comply with all NAR Code of Ethics requirements regarding confidentiality
  • Report any suspected breaches of confidentiality to your association administrator

Document Submission & Content

Your Responsibility

When submitting documents and content to Ethication™:

  • You retain ownership of your submitted materials
  • You grant Ethication™ a limited, non-exclusive license to process, store, and display your content solely for case management purposes
  • You represent that you have the right to submit all uploaded materials
  • You are responsible for ensuring documents do not contain viruses or malicious code
  • You understand that submitted documents may be processed using OCR and AI analysis

Prohibited Content

Do not upload content that:

  • Is false, defamatory, or intended to harass
  • Violates any third-party rights (copyright, trademark, privacy)
  • Contains explicit, offensive, or inappropriate material unrelated to the case
  • Includes malware, viruses, or harmful code

Communications & Notifications

SMS & Email Notifications

By using Ethication™, you consent to receive:

  • SMS messages for phone verification, case updates, and time-sensitive notifications
  • Email communications regarding case status, hearings, and administrative matters
  • Platform notifications and alerts

These communications are essential to platform operation. Opting out may limit your ability to use certain features. See our SMS Consent Policy for details.

Digital Signatures

When you create a digital signature through Ethication™:

  • You agree that your digital signature has the same legal effect as a handwritten signature
  • You understand that signatures are verified via SMS to your registered phone number
  • You are responsible for all documents signed using your account

Multi-Tenant Architecture & Data Isolation

Ethication™ uses a multi-tenant architecture with complete data isolation:

  • Each REALTOR® Association's data is completely isolated from other associations
  • You can only access data for your association and assigned cases
  • Cross-tenant data access is technically prevented through Row Level Security (RLS)
  • Each association's administrators control access within their organization

AI & Automated Processing

Ethication™ uses artificial intelligence and automated processing for:

  • Document OCR: Extracting text from scanned documents
  • AI Summarization: Creating summaries of case documents (via OpenAI)
  • Key Information Extraction: Identifying relevant details in submissions
  • PDF Generation: Automatically creating NAR-compliant forms

Important: AI analysis is provided as a tool to assist users. It does not replace human review or decision-making. All case determinations must be made by authorized committee members. You should always review AI-generated summaries for accuracy. We are not liable for any errors or omissions in AI-generated content.

Service Availability & Modifications

Platform Availability

We strive to maintain high uptime but cannot guarantee uninterrupted access. The platform may be unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency security updates
  • Technical issues or outages
  • Third-party service disruptions

Modifications to Service

We reserve the right to modify, update, or discontinue features with reasonable notice. We will notify users of material changes via email or platform notification.

Third-Party Links & Services

Ethication™ may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is governed by their respective terms and policies.

Intellectual Property

Platform Ownership

Ethication™, including all software, design, content, trademarks, and the Ethication™ name and logo, is owned by Warren Burrows and protected by copyright and intellectual property laws. You may not use, copy, or reproduce any Ethication™ trademarks or branding without prior written consent.

NAR Forms & Materials

NAR forms and templates used in Ethication™ are the intellectual property of the National Association of REALTORS®. Use of these forms is authorized for official ethics case management only.

Limitation of Liability

To the fullest extent permitted by law:

  • Ethication™ is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from platform use
  • We do not guarantee the accuracy of AI-generated summaries or automated processing
  • We are not responsible for decisions made by users based on platform data
  • Total liability shall not exceed the fees paid by your association for platform access in the twelve (12) months preceding the claim

Indemnification

You agree to indemnify, defend, and hold harmless Warren Burrows, Ethication™, its affiliates, officers, employees, and participating associations from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your violation of these Terms & Conditions
  • Your submission of false or defamatory content
  • Your breach of confidentiality obligations
  • Your unauthorized access to data or accounts
  • Your use of the platform in violation of applicable law

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, cyberattacks, pandemics, or other force majeure events.

Termination

By You

You may request account deletion by contacting your association administrator. Note that case data may be retained as required by law or NAR retention requirements.

By Us

We may suspend or terminate your access if you:

  • Violate these Terms & Conditions
  • Engage in fraudulent or malicious activity
  • Compromise platform security
  • Are no longer eligible to use the platform (e.g., association membership ends)

Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including confidentiality, limitation of liability, and indemnification) will remain in effect.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of Ethication™ shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, conducted in the State of Texas. You agree to waive any right to a jury trial.

Changes to Terms

We may update these Terms & Conditions periodically. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of Ethication™ after changes constitutes acceptance of updated terms. If you disagree with any changes, your sole remedy is to discontinue use of the platform.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy and SMS Consent Policy, constitute the entire agreement between you and Warren Burrows regarding your use of Ethication™ and supersede all prior agreements, understandings, and communications.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
